Ferkesh Hosting (Ferkesh)

This Anti-Spam Policy (“Policy”) outlines the rules for sending email and using email services provided through Ferkesh Hosting. By using any Ferkesh services, including hosting, email accounts, domain services, or our network, you agree to follow this Policy.

Spam harms users, damages reputation, and disrupts networks. Ferkesh maintains a strict zero-tolerance policy against spam.

1. Definition of Spam

“Spam” includes, but is not limited to:

• Unsolicited Bulk Email (UBE)

• Unsolicited Commercial Email (UCE)

• Marketing or promotional messages sent without permission

• Mass emails sent to purchased/scraped email lists

• Emails with forged headers or misleading subject lines

• Chain letters, pyramid schemes, affiliate spam

• Hosting spam landing pages or spam redirect URLs

If you send any email to someone who has not explicitly requested or agreed to receive it, it is considered spam.

2. Prohibited Activities

The following activities are strictly prohibited under Ferkesh Hosting:

❌ Unsolicited mass emailing

Sending bulk email messages without verified opt-in permission.

❌ Using purchased, rented, or scraped email lists

You may not import or email any list you did not build organically.

❌ Forged or manipulated headers

Including false sender information, fake names, or misleading metadata.

❌ Hosting spam-related content

Hosting websites, landing pages, redirects, click-tracking systems, or affiliate pages used for spam.

❌ Sending email from compromised accounts

Accounts sending spam due to malware, hacked password, or insecure scripts will be suspended.

❌ Open relay configuration

Operating an SMTP server configured as an open relay.

❌ Using Ferkesh servers for mailing lists without double opt-in

Single opt-in or list imports without proof of consent are prohibited.

3. Customer Responsibilities

All customers must:

• Maintain secure passwords

• Keep websites free from malware

• Ensure scripts/forms cannot be abused

• Use double opt-in for mailing lists

• Maintain proof of user consent

• Include a valid unsubscribe link

• Honor all unsubscribe requests within 5 days

Customers are responsible for all email sent from their hosting accounts, including compromised accounts.

4. Mail Sending Limits

Ferkesh may enforce limits on emails sent per hour or per day depending on your hosting plan.

Sending excessive email may trigger automated throttling or temporary mail suspension to protect network integrity.

5. Monitoring & Enforcement

To protect our network, we may:

• Scan outgoing email for spam characteristics

• Rate-limit suspicious email activity

• Temporarily disable email services

• Suspend hosting accounts involved in spamming

• Permanently terminate accounts for repeated violations

We follow all applicable laws including:

• CAN-SPAM Act (USA)

• GDPR principles (EU recipients)

• Local anti-spam regulations where required

6. Reporting Spam

If you believe a Ferkesh Hosting customer is sending spam or abusing email services, please report it immediately.

Reports must include:

• The full email headers

• The message content

• The sender email and domain

• Any related URLs

We investigate all abuse reports promptly.

7. Actions Taken for Violations

If a customer violates this Policy, Ferkesh may:

1. Issue a warning

2. Temporarily block outgoing mail

3. Suspend the hosting account

4. Disable email services

5. Terminate the account without refund

6. Charge cleanup fees for IP blacklist removal

7. Cooperate with law enforcement when required

Repeated violations will result in permanent suspension.

8. IP Blacklisting & Reputation

If a customer’s email activity results in:

• IP blacklisting

• Mail reputation damage

• Complaints from recipients or providers

Ferkesh reserves the right to:

• Suspend outbound email

• Assign a new IP (fees may apply)

• Terminate services for repeated offenses

9. Mass Emailing / Newsletters

Mass emailing is allowed only if all conditions are met:

✔ Double opt-in list
✔ Full record of subscriber consent
✔ Easy and working unsubscribe link
✔ Sender information and physical address included
✔ No purchased, borrowed, or scraped lists
✔ Complies with CAN-SPAM or equivalent laws

External mailing services such as Mailgun, SendGrid, Amazon SES, or Mailchimp are recommended.

10. Policy Updates

Ferkesh may modify this Policy at any time. Updated versions will be posted on our website. Continued use of services constitutes acceptance of the updated terms.
