This DMCA / Copyright Policy (“Policy”) explains how Ferkesh Hosting, operated by Ferkesh, handles complaints regarding copyright infringement. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid takedown notices.
1. Overview
Ferkesh Hosting is a service provider and does not monitor or control the content uploaded or hosted by customers. However, we take copyright infringement seriously and will act on valid DMCA notices submitted in accordance with U.S. law.
This Policy applies to all hosting accounts, websites, files, and content stored or transmitted through our network.
2. How to File a DMCA Takedown Notice
If you believe your copyrighted material is being used or distributed without authorization through a website hosted by Ferkesh Hosting, you may submit a DMCA takedown notice.
Your notice must include ALL of the following:
- Your full legal name and contact information (email and physical address).
- Identification of the copyrighted work you claim has been infringed.
- The exact URL(s) or location of the infringing material.
- A statement confirming that you believe in good faith that the use is not authorized by the copyright owner or law.
- A statement, under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
- Your physical or electronic signature.

3. What Happens After a DMCA Notice Is Submitted
Once a valid DMCA notice is received, Ferkesh Hosting will:
- Review the notice for completeness
- Temporarily disable or restrict access to the allegedly infringing content
- Notify the customer responsible for the content
- Provide instructions for submitting a counter-notification (if applicable)
We may remove, disable, or suspend access to content or services if required by the DMCA.
4. Counter-Notification (If You Believe the Claim Is Incorrect)
If content was removed or disabled due to a DMCA notice and you believe it was done in error, you may submit a DMCA counter-notification.
Your counter-notice must include:
- Your full name, address, and contact information
- Identification of the removed content and its location before removal
- A statement, under penalty of perjury, that you believe the content was removed due to mistake or misidentification
- A statement that you consent to U.S. court jurisdiction if the copyright owner files a claim
- Your electronic or physical signature
After receiving a valid counter-notification:
- We will forward it to the original complainant
- The complainant will have 10–14 days to file a court action
- If no action is filed, access to the content may be restored
5. Repeat Infringer Policy
Accounts with repeated or severe copyright violations may be:
- Suspended
- Terminated
- Denied future service
Ferkesh Hosting reserves the right to permanently close accounts associated with repeated DMCA violations.
6. Misuse of the DMCA
Submitting false or fraudulent DMCA notices or counter-notices is illegal and may result in legal liability, damages, or termination of your account.

Ferkesh Hosting does not provide legal advice. If you are unsure whether content is infringing, consult a qualified attorney before submitting a DMCA notice.
