Trademark Disputes for Domain Names

Ferkesh Hosting (Ferkesh)

If you believe a domain name registered through Ferkesh Hosting infringes upon your trademark or intellectual property rights, the appropriate resolution process is handled through ICANN, not Ferkesh directly.

1. Domain Name Trademark Disputes (UDRP)

For disputes involving trademark rights within a registered domain name, please refer to:

ICANN’s Uniform Domain-Name Dispute-Resolution Policy (UDRP)

This policy outlines the official procedure for resolving trademark/domain conflicts.

UDRP Information:
https://www.icann.org/resources/pages/udrp-2012-02-25-en

UDRP complaints are filed through approved dispute-resolution providers, not Ferkesh Hosting.

Ferkesh Hosting cannot modify, suspend, or transfer a domain based solely on a trademark complaint without an official UDRP ruling or valid court order.

2. Trademark Misuse on Websites Hosted by Ferkesh

If your trademark is being used within website content hosted on our servers, and not within the domain itself, you may submit a complaint to our Abuse Team.

Submit a Report

To report trademark misuse on a hosted website, please open an abuse ticket through your client portal under:

Abuse / Report Violations

We will review the complaint and take action in accordance with:

  • U.S. intellectual property laws

  • DMCA guidelines

  • Ferkesh Hosting’s Acceptable Use Policy

3. Required Information for Trademark Complaints

To process a trademark-related complaint, you must provide:

  • Your full legal name

  • Proof of trademark ownership (registered or common law)

  • The exact domain or URL in question

  • A detailed explanation of the alleged violation

  • Supporting evidence (screenshots, legal filings, etc.)

  • Your contact information and preferred communication method

Incomplete complaints may delay review.

4. Limitations & Notice

Ferkesh Hosting:

  • Does not determine trademark ownership

  • Does not mediate legal disputes

  • Must follow ICANN rules, UDRP decisions, and valid court orders

  • Will cooperate fully with UDRP outcomes and legal authorities
