FERKESH HOSTING — USER AGREEMENT

This User Agreement (“Agreement”) governs your access to and use of the services, website, client portal, hosting, domain registration, and related products provided by Ferkesh Hosting, operated by Ferkesh (“we”, “us”, “our”).

By creating an account, purchasing any service, or using any part of the Ferkesh Hosting platform, you agree to this Agreement.

1. Eligibility

1.1 You must be at least 18 years old to create an account or use our services.
1.2 You must use our services for lawful purposes only.
1.3 By registering, you confirm that all information you provide is accurate and truthful.

2. Account Registration & Security

2.1 You must provide accurate information when creating your account, including:

• Name

• Valid email

• Accurate billing information

2.2 You are responsible for maintaining the confidentiality of your login credentials.
2.3 You are fully responsible for all actions taken under your account.
2.4 If you suspect your account is compromised, you must notify us immediately.

3. Acceptable Use

3.1 You must comply with all Ferkesh Hosting policies, including:

• Terms of Service (TOS)

• Anti-Spam Policy

• Privacy & Confidentiality Agreement

• Domain Registration Agreement

• Refund Policy

• DMCA Policy

• Abuse Policy

3.2 You agree not to use our services for:

• Illegal activity

• Spam or unsolicited email

• Phishing, fraud, or malware

• Copyright or trademark infringement

• Hosting harmful scripts or abusive content

• Attempting to harm or disrupt our network or customers

• Harassment of staff or abuse of support channels

4. Billing & Payments

4.1 All services must be paid in advance unless stated otherwise.
4.2 Automatic renewal applies unless you disable it in your client portal.
4.3 Failure to pay may result in:

• Suspension

• Termination

• Loss of data

• Loss of domain names

• Collection and administrative fees

4.4 Chargebacks result in immediate account suspension and investigation.

5. Refunds

Refunds are governed by our Refund Policy.
By using our services, you agree to the refund rules published on our website.

Key points:

• Hosting may include a 30-day money-back guarantee (if applicable).

• Domain fees are non-refundable.

• Web design, SEO, marketing, and setup fees are non-refundable.

• Refunds are not given for accounts suspended due to policy violations.

6. Support & Ticket System

6.1 Support is provided exclusively via ticket system inside your client portal.
6.2 Account verification may be required for security.
6.3 Support does not include:

• Website design

• Coding support

• Custom script troubleshooting

• Third-party software assistance

7. Data Security & Backups

7.1 Ferkesh Hosting provides backups as part of your hosting plan, but:

• Backups are not guaranteed

• Backups may not be available in all situations

• You are responsible for keeping your own backups

7.2 Ferkesh Hosting is not liable for:

• Data loss

• Hacked websites

• Deleted files

• Customer error

8. Domains

Domain registrations, renewals, transfers, and disputes are governed by our Domain Registration Agreement and ICANN policies.

You are responsible for ensuring domains are renewed before expiration.

9. Service Suspension & Termination

We may suspend or terminate your account if:

• You violate this Agreement

• You violate the AUP, Anti-Spam, or Abuse Policy

• You fail to pay

• You file a chargeback

• You engage in fraudulent, illegal, or abusive activity

• You pose a risk to other customers or our network

Terminated accounts receive no refund for policy violations.

10. Liability Limitation

To the fullest extent permitted by law:

• Ferkesh Hosting is not liable for indirect, incidental, or consequential damages.

• Ferkesh Hosting is not liable for:

  • Data loss

  • Downtime

  • Service interruption

  • Domain expiration

  • DNS failures

  • Third-party issues

• Our total liability is limited to the amount you paid to Ferkesh Hosting in the last 90 days.

11. Privacy

Your information is handled according to our Personal Data and General Confidentiality Agreement.

By using our services, you consent to the collection and use of your information as described in our privacy policies.

12. Changes to This Agreement

Ferkesh Hosting may modify this Agreement at any time.
Updated versions will be posted on our website.
Continued use of services constitutes acceptance of updated terms.

13. Governing Law

This Agreement is governed by the laws of the United States, unless local consumer laws apply to you.

14. Acceptance

By creating an account or using any Ferkesh Hosting service, you acknowledge that you have read, understood, and agreed to this User Agreement and all related policies.
